Case Result #1

Our client, a 51 year-old woman went to defendant's office to pick up some of her medical records when she opened the door to walk in and immediately tripped over a 5-inch step up at the threshold. Our client injured her shoulder, which eventually required surgery to repair, and incurred over $40,000 in medical bills. The Insurance company representing the owner of the premises denied any liability stating it was an "open and obvious condition" that our client should have seen. We hired an engineered and who performed a thorough inspection of the premises and several building code violations were found. We filed a lawsuit on behalf of our client and after aggressively litigating the matter for over a year, the case settled for $125,000.

While exiting her apartment, our client, slipped backwards falling down an entire flight of stairs. The steps were part of a deck constructed from wood and most of the steps were covered with mold causing them to be slippery. Additionally, our client was unable to stop from falling due to the instability of the railing. Due to this fall, she sustained several herniated discs in her neck and after months of medical treatment, she underwent an anterior cervical diskectomy and fusion surgery. As a direct result of the injuries sustained in the fall, she incurred over $150,000 in medical bills.

After presenting a settlement demand to the insurance company for the apartment complex, their attorney offered our client a "nuisance" offer of $50,000 because they felt our client knew the condition of the steps and should have been watching where she was going. After filing a lawsuit and aggressively litigating the case for over a year, we were able to resolve the case before trial for $300,000.

Our client received burns on her hands from the rupturing of her vehicle's air bags, as well as injuries to her neck, back and right knee. She was later diagnosed with tear of the lateral meniscus and a partial tear of the anterior cruciate ligament. Our client eventually underwent arthroscopic surgery to repair her knee and incurred approximately $44,000 in past medicals bills and lost wages. Our client was travelling on the Veteran's Expressway and stopped for traffic when she was rear-ended by the defendant's vehicle. Our 24 year-old client underwent conservative treatment with a variety of treating doctors and was diagnosed with herniated discs/annular tears in her neck and back. After submitting a settlement demand to the defendant's insurance company, we were told they had conducted a review of her medical records disputing the cause of her injuries, so we promptly filed a lawsuit. The injuries to our client's neck resulted in a percutaneous discectomy surgery and she incurred over $100,000 in past medical bills as a result of her injuries. After litigating the case for over one year, our client resolved her case at mediation for $300,000.
